2nti St. TOKYO (AP) Strict laws virtually banning heart transplants in Japan forced 8-year-old Mi3ruki Monobe to seek a donor in the United States. There, she died waiting. The Tokyo second-grader, who was born with a hole in her heart, was flown to UCLA Medical Center in critical condition last month because Japanese laws make heart and liver transplants virtually impossible. She died Tuesday.

Transplant advocates hope that, after decades of hand-wringing and legal squabbles, new legislation will allow others life-saving surgery in Japan. Since 1984, nearly 200 Japanese heart and liver patients have undergone transplants overseas. Another four to five die each day in Japan. In Japan, a patient is considered dead when the heart has stopped beating. Once that happens, organs quickly deteriorate and become unsuitable for transplant.

So transplants are limited to corneas, kidneys, liver sections organs less prone to rapid deterioration or from living donors. In what would be a breakthrough for transplant advocates, two competing bills before Japan's Parliament would make it possible for doctors to transplant organs from brain-dead donors. One, submitted by a lawmaker who is also a doctor, defines brain death as a legal standard of death. The other stops short of that, but says organs from brain-dead patients can be used for transplant if the donor has left a clear will to that effect. The only heart transplant attempted in Japan was done in 1968.

It failed, and the doctor was widely criticized. Today, the medical community generally supports adjusting the law, and the Japan Transplant Society is making plans for regional centers where heart and liver transplants can be performed. Public opinion is mixed. Leading religious groups issued a statement this week opposing legal recognition of brain death. Opponents argue that doctors may be more concerned with getting fresh organs for transplants than with saving the lives of potential donors.
