Description

Product Creation and Communication
Field of the invention
The present invention relates generally to creating digital products and the communication thereof.
Although the present invention will be described with particular reference to generating a . product comprising a message having content associated with a celebrity for communication via Multimedia Message Service (MMS) protocol, it will be appreciated that the invention may be used to create digital products having any content and using other communication technologies.
Throughout the specification, unless the context requires otherwise, the word "comprise" or variations such as "comprises" or "comprising", will be understood to imply the inclusion of a stated integer or group of integers but not the exclusion of any other integer or group of integers.
Furthermore, throughout the specification, unless the context requires otherwise, the word "include" or variations such as "includes" or "including", will be understood to imply the inclusion of a stated integer or group of integers but not the exclusion of any other integer or group of integers.
Additionally, throughout the specification, unless the context requires otherwise, the words "substantially" or "about" will be understood to not be limited to the value for the range qualified by the terms.

The following discussion of the background to the invention is intended to facilitate an understanding of the present invention only. It should be appreciated that the discussion is not an acknowledgement or admission that any of the material referred to was published, known or part of the common general knowledge of the person skilled in the art in any jurisdiction as at the priority date of the invention.
Many people like to obtain material associated with or deriving from well known identities, celebrities or stars, such as images of them, or their autographs. As a general rule, the material may be more valuable (at least to the individual concerned) if it is personalised for them in some way, such as if the image is of them shaking hands with the celebrity, or has been "approved" or otherwise authenticated for them or validly derived from the celebrity.
Systems have been disclosed in which a person may pay to receive a telephone call from a celebrity. However, such calls must be arranged in advance and, similar to engaging a celebrity to appear at a function, can be expensive.
Videos and images of celebrities are also available and can be communicated as part of a message. However, these may be parodies or impersonations of the celebrities concerned, or obtained or created without their permission or authorisation, and hence may be undesirable.
In regard to autographs, some celebrities still enjoy signing autographs for free for fans, keeping it an interesting hobby. However, many people who will stand outside premieres, concerts, etc, and ask for autographs from celebrities are actually professional autograph traders or dealers, who then sell any obtained autographs for profit, rather than fans personally interested in the celebrity and in keeping and treasuring the autograph. Because of this reason at least, some celebrities are not willing to distibute their signature unless paid to do so.
Furthermore, realising the potential profit in the sale of pop culture autographs, many professional autograph dealers will wait for hours for a celebrity to emerge from a location, present several photographs for the celebrity to sign, and then subsequently seek to sell them for a profit. Some dealers will locate a celebrity's home address and write to them repeatedly asking for autographs. Celebrities often soon grow tired of such practices and limit their responses, to the detriment of legitimate fans. Disclosure of the Invention
The present invention seeks to overcome to at least some extent, or at least ameliorate, one or more of the deficiencies of prior art, or to provide the consumer with a useful or commercial choice.
Other advantages of the present invention will become apparent from the following description, - taken in connection with the accompanying drawings, wherein, by way of illustration and example only, preferred embodiments of the present invention are disclosed.
According to a first broad aspect of the present invention, there is provided a system for generating a product, the system comprising processor means and a storage means, the storage means having a software application and a database of content stored thereon, whereby the processor is operable, under control of the software application, to: receive a request for the product, the request comprising a specification of content from the database to be included in the product; and generate the product on the basis of the request.
Preferably, the content is derived from a source, and an authentication is associated with the content to indicate valid derivation from the source.
In a particular preferred form, the source is a celebrity, and the content comprises at least one of: a photograph of the celebrity; audio from the celebrity; text from the celebrity; and/or video of the celebrity. In this case, the authentication may comprise an autograph or signature of the celebrity.
Preferably, the system is operable to communicate with a device. The system is operable to communicate the product to the device for execution via a user interface of the device.
Preferably, the communication is via the Internet, in which case the device comprises an Internet enabled device. The device may comprise any mobile communication device, including a personal, notebook or tablet computer such as that marketed under the trade mark IPAD® by Apple Inc, or a smartphone such as that marketed under the trade mark IPHONE® by Apple Inc.

Preferably, the user interface comprises a graphical user interface or human machine interface comprising a display or touch screen.
Preferably, the system is operable to receive a data communication from the device. Preferably, the data communication comprises the request for the product.
According to a second broad aspect of the present invention, there is provided a method of generating a product, the method comprising: receiving a request for the product, the request comprising a specification of content to be included in the product; and generating the product on the basis of the request.
Preferably, the content is derived from a source, arid the method comprises associating an authentication with the content to indicate valid derivation from the source.
In a particular preferred form, the source is a celebrity, and the content comprises at least one of: a photograph of the celebrity; audio from the celebrity; text from the celebrity; and/or video of the celebrity. In this case, the authentication may comprise an autograph or signature of the celebrity.
According to. a third broad aspect of the present invention, there is provided a computer-readable storage medium on which is stored instructions that, when executed by a computing means, causes the computing means to perform the method of generating a product according to the second broad aspect of the present invention as hereinbefore described. According to a fourth broad aspect of the present invention, there is provided a computing means programmed to carry out the method of generating a product according to the second broad aspect of the present invention as hereinbefore described.

Best ode(s) for Carrying out the Invention
In Figure 1 , there is depicted a first embodiment of a system for generating a product (product generation system) 10 in accordance with an aspect of the present invention. The product generation system 10 is provided under the trade mark twiy™ in the first embodiment.
In the embodiment described, the product comprises a message having content associated with or relating to a celebrity for communication via Multimedia Message Service (MMS) protocol. The system 10 is operable to receive a request for the message, the request comprising a specification of the content to be included in the message, and to generate or create the message on the basis of the request, as will be described in further detail below.
In alternative embodiments of the invention, products other than a message may be generated, including artistic works or new media art, music, or games, for example. It should be appreciated that the product content is not limited to being associated with or related to a celebrity, and may comprise any content, relating to or associated with any subject matter.
The product generation system 10 comprises a set of system and application software (software set) stored and run on a product provider computer 12 as depicted in Figure 2. Software in the software set, or any set of instructions or programs for the product provider computer 12, can be written in any suitable language, as are well known to persons skilled in the art. Software in the software set can be provided as standalone applications or via a network, depending on the system requirements.
The computer 12 can be of any suitable type, such as a personal computer, a dedicated server or networked servers.
In the embodiment described, the computer 12 includes display means in the form of a monitor or visual display 14, a container such as a box 16 for housing various, operably connected components of the computer 12 such as the motherboard, processing means, disk drives and power supply of the computer 12, and control means such as a keyboard 18 and other suitable peripheral devices such as a mouse (not depicted). Together, the display 14, keyboard 18 and other peripheral devices provide a user interface or Human or Man Machine Interface (HMI) to enable an operator to interact with the software set.
Referring to Figure 3, processing means of the computer 12 includes a central processor 20. The computer 12 also includes a storage means or medium such as a memory device 22 for the storage and running of software, including the software of the software set. The processor 20 is operable to perform actions under control of the software of the software set, as will be described in further detail below. The use and operation of computers using software applications is well-known to persons skilled in the art and need not be described in any further detail herein except as is relevant to the present invention.
In the embodiment described, the software set comprises: an operating system (not shown); a web server application 24; a billing application 26; an email application 28; an MSS application 30; and a product generation application 32.
The web server application 24 is operable to provide information relating to content that may be included in a product via a dedicated product generation website, such as web pages or other electronic pages or screens, to clients, such as a customer or consumer. The website is accessible by the customer via a web browser of an Internet enabled communication device, such as a notebook computer (customer's computer) 34 or a smartphone (customer's smartphone) 36, operably connected to be in data communication with the product generation system 10 via a communication network. In the embodiment described, the means of data communication is via the Internet 38, however, other methods, such as direct connection, may be employed in other embodiments of the invention.
The device may be any device capable of communicating with the product generation system 10, including a personal, notebook or tablet computer such as that marketed under the trade mark IPAD® by Apple Inc, or a smartphone such as that marketed under the trade mark IPHONE® by Apple Inc.
Any suitable communication protocol can be used to facilitate the communication of information or data between components of the product generation system 10, and between the product generation system 10 and other devices, including wired and wireless, as are well known to persons skilled in the art and need not be described in any further detail herein except as is relevant to the present invention.
One of the web pages that may be accessed comprises an online product request page. The web server application 24 is operable to enable the customer to select a product to be generated, and the content to be included in the product, by completing and submitting to the computer 12, via the product request page, a communication in the form of a product request comprising content specification information. The use of web pages and the inputting and reading of data therefrom is well known to persons skilled in the art and need not be described in any further detail herein except as is relevant to the present invention.
The submitted content specification information includes details or data relating to specific content to be included in the product. In the embodiment described, content that may be specified in the specification includes authenticated content contained in an authenticated content database 40, and unauthenticated content that may be submitted by the customer for inclusion in the product via the online product request page.
The database 40 is coupled to the computer 12 and is in data communication therewith in order to enable data to be read to and from the database 40, as is well known to persons skilled in the art. Any suitable database structure can be used. The database can be provided locally as a component of the computer 12 (such as in the memory device 22) or remotely such as on a remote server, as can the set of software. In an embodiment, several computers can be set up in this way to have a network client-server application. There is at least one database for the product generation system 10 in the embodiment described - the authenticated content database 40 - and it is stored in the memory device 22 of the computer 12. In alternative embodiments of the invention, there may be more than one database.
The database 40 has a plurality of content records. Each content record comprises content derived from a particular source. In the embodiment described, each source is a celebrity. The celebrity may be a sporting, music, television, film, political, or historical celebrity, or any other well known identity, and may be a real person or a fictitious character. The content associated with each record may include one or more of: a photograph or other visual representation or image of the celebrity; an audio file of the voice of the celebrity reciting, for example, a message or a well known catch phrase associated with them; a video of the celebrity; and/or text written by the celebrity. An authentication is associated with the content of each record to indicate, that the content has been validly derived from, and has the authorisation or approval of, the source. In the embodiment described, the authentication comprises an autograph or signature of the celebrity (in the case of a real person), or other authorised person, such as the creater or author in the case where the celebrity is a fictitious character.
The unauthenticated content submitted by the customer can be any material that the customer wishes to include in the product to be generated, such as a personalised text message from the customer to the intended recipient of the product.
Via the product request page, the customer is able to navigate and select the product to be generated, the authenticated content (from the database 40) to be included in the product, along with the unauthenticated content, and to submit details of their selections in the content specification information of the request.
The billing application 26 is operable to integrate with payment gateways and terminals to provide a payment facility via which payment for a product may be made by the customer, either via an electronic payment page/screen of the dedicated product generation website (utilising a credit or debit card, PayPal, or similar payment method). In particular, the billing application 26 is operable to facilitate the acceptance of payments, create and monitor related invoices and receipts, screen fraud, communicate with gateways and credit card processors, and record data and information relating to such activities, for example.
In embodiments of the invention, the billing application 26 is operable to allow the customer to register or record themselves as a customer of products and create a personalised customer account from which payment for products may be made. To do this, the customer completes and submits to the computer 12, via an online registration page, a communication in the form of an electronic registration form comprising customer registration information. The customer registration information includes details or data relating to the customer including their name(s), financial details of accounts, and contact information including their physical/postal address, email address and a number of the customer's smartphone 36. Submitted customer registration information is stored in a customer record assigned to the customer in a registered customer database. The billing application 26 is operable to allocate an identifier for the personalised customer account comprising account detail information which is associated with the customer record and communicated to the customer via the customer's computer 34 or smartphone 36, and used in the billing of the customer. Another of the web pages that may be accessed comprises an intended recipient details page. The web server application 24 is operable to enable the customer to provide contact information for an intended receipient of a product to be generated, by completing and submitting to the computer 12, via the intended recipient details page, a communication in the form of an intended recipient notification comprising intended recipient information. The intended recipient information includes a number of a smartphone 42 of the intended recipient of the product (recipient's smartphone) and may also include an email address of the intended recipient.
The email application 28 is operable to enable email message communication between the product generation system 10 and devices in communication therewith, such as the customer's computer 34, the customer's smartphone 36, the recipient's smartphone 42 and/or a computer (not shown) of the recipient. "
The MSS application 30 is operable to enable MSS message communication between the the product generation system 10 and devices in communication therewith, such as the recipient's smartphone 42.
The use and operation of computers using software, smartphones, the Internet, web server applications, billing applications, payment portals, email applications, and MSS applications are well known to persons skilled in the art and need not be described in any further detail herein except as is relevant to the present invention.
The product generation application 32 comprises product generation logic that is operable to generate or compile a product on the basis of the received content specification information as will be described in further detail below.
The product generation system 10, under control of relevant applications of the software set, is operable to generate, populate and manage records in the authenticated content database 40, any other databases such as the registered customer database, and execute actions as described herein according to the data and information received by the computer 12.
The above and other features and advantages of the embodiment of the invention will now be further described with reference to the product generation system 10 in use.
As depicted in Figure 4, to purchase a product the customer first accesses the dedicated product generation website, using the customer's computer 34 or smartphone 36, and navigates to the product request page. Via the product request page the customer selects or chooses the subject matter of the product to be created. In the embodiment described, the subject matter is a celebrity relating to content contained in the authenticated content database 40.
Once the subject celebrity has been chosen the customer selects the product to be created by the product generation system 10. In the embodiment described, two products are available - a photograph message or a video message. As described previously, in alternative embodiments of the invention, alternative products may be available to be generated.
If a video message is selected, then the customer selects a theme for the video message from video message themed content for the celebrity contained in the authenticated content database 40. In the embodiment described, the video message themed content comprises video of the celebrity as well as audio content.
If the customer chooses to have a photograph message product created, then the customer selects a theme for the photograph message from photographic message themed content for the celebrity contained in the authenticated content database 40. The customer also selects whether they wish for audio content to be included in the product, such as a message spoken by the celebrity.
The authenticated content database 40 may comprise content relating to any theme, including, for example, "Happy Bithday", "Happy Anniversary", "Congratulations on your Graduation!", etc.
The customer may also optionally enter personalised text to comprise part of the video or photograph message. Such personalised text comprises unauthenticated content to be included in the product.
The selections made by the customer, of authenticated content from the authenticated content database 40 and unauthenticated content such as a formulated text message, comprise content specification information which is then communicated to the computer 12.
On receipt of the content specification information, the processor 20, under control of the product generation application 32, is operable to process the content specification information and to generate a product on the basis thereof. This action comprises retrieving the selected authenticated content from the authenticated content database 40 and compiling or configuring the retrieved authenticated content, together with the submitted unauthenticated content, in a video message or photograph message format as appropriate. As well as including the selected content, the configured video message or photograph message includes or is branded with the authentication associated with the retrieved authenticated content. In embodiments of the invention, it may also include a trade mark under which the product generation system 10 and associated services are provided, such as the twiy™ logo in the embodiment described.
Once the product is configured, the product generation system 10 is operable to obtain payment for the product from the customer via the billing application 26.
Once payment for the product has been confirmed, the product generation system 10 is operable to request details of an intended recipient of the product via the intended recipient details page. Completion of the intended recipient details page by the customer results in an intended recipient notification comprising intended recipient information (including the number of the recipient's smartphone 42 and/or the email address of the recipient) being communicated to the product generation system 10.
On receipt of the intended recipient information, the processor 20, under control of the MSS application 30, is operable to communicate the generated product (i.e. the configured video message or photograph message) to the recipient's smartphone 42 via MSS protocol.
As part of the MSS protocol, a Multimedia Messaging Service Centre (MSCC) receives the configured video message or photograph message, and associated billing details. The recipient, via the recipient's smartphone 42, receives notification of receipt of the configured video message or photograph message by the MSCC and retrieves the same in accordance with MSS protocol.
Additionally or alternatively, at the customer's selection, the processor 20, under control of the email application 28, is operable to communicate the generated product (i.e. the configured video message or photograph message) in an email to the email address of the recipient and accessible by the recipient via the recipient's smartphone 42.
Figure 5 depicts an example of a product 101 in the form of a configured video message or photograph message generated via the product generation system 10. The product 101 comprises: the selected video or photographic representation 103 of the celebrity (i.e the football (or soccer in some countries) player Stanley "Stan" Lazaridis in the example depicted in Figure 5); the selected audio 105 of the celebrity (i.e! "Hi there - it's Stan here. Your invited to a birthday party. I hope you can come!" in the example depicted in Figure 5); the authentication 107 (i.e. Stan's autograph in the example depicted in Figure 5); the formated text message (unauthenticated content) 109 (i.e. Your invited to my Birthday! I've invited Stan so see you there! John" in the example depicted in Figure 5); and the twiy™ logo 1 1 1.
It can be appreciated that, in embodiments of the invention, products comprising any content, relating to or associated with any subject matter or theme, may be created.
As another example, a product generated by the product generation system 10 may comprise a configured video message having a video/audio clip of Miley Cyrus saying: "Hi it's Miley Cyrus here! I heard it was your birthday! Congratulations and happy birthday! I hope you have an awesome day. Take care!" accompanied by a formated text message of "Happy Birthday Jemma!" from the customer.
A further example of a product generated by the product generation system 10 may comprise a configured photograph message having a photograph of the fictional character Moe Szyslak from the American animated sitcom The Simpsons®, autographed by creator Matt Groening or and/or other authorised person(s), and accompanied by an audio message by actor Hank Azaria (who voices Moe) saying: "I heard you were having a bad day - that makes two of us!".
It can be appreciated that the embodiment of the invention allows clients or consumers (such as the public at large) to access authenticated content related to a favourite celebrity and send that authenticated content, as a product, to an intended recipient or end user. As a consequence of the authentication, the recipient may be confident or guaranteed that they have received a product comprising exclusive authentic content such as a photograph or video including an authenticated and legitimate autograph of the relevant celebrity. '
Furthermore, embodiments of the invention allow consumers to access and procure authentic photographs, video, audio and autographs of favourite celebrities and adapt such content for multi-functional use.
Additionally, embodiments of the invention allow for the provision of a worldwide environment in which celebrities can allow fans to validly access related content such as media and autographs. Embodiments may also ensure authorised access of such media and autographs and may guarantee celebrities a monetary reward for inclusion of authorised content such as photographs, video, audio, and autographs. Celebrities may also benefit from the authorised use of related content such as images, videos and autographs. In this regard, celebrities may benefit at the point of sale of products generated by the system of the invention and achieve a sense of control over autographs and related media.
In the embodiment described, the method and apparatus used to capture and authenticate content populating the authenticated content database 40 varies according to the content, as depicted in Figure 6.
In the case of photographic content, the method comprises capturing a photograph of the source (a celebrity in the embodiment described) by digital camera. The captured photograph is then printed on suitable, photographic paper. Authentication from the source is then obtained by the celebrity visually sighting and autographing the printed photograph if approved. The autographed photograph is then drum scanned at high resolution and saved in the relevant content record for the celebrity in the authenticated content database 40. Optionally, a trade mark under which the product generation system 10 is provided, such as the twiy™ logo, is digitally pasted onto the image. Where the source is an animation, the animation is reproduced to photograph and authenticated by the owner or illustrator of the animation autographing the photograph if approved, prior to scanning, saving and digitally pasting a trade mark to the image as described above.
In the case of audio content, an audio message comprising the voice of the celebrity (in the embodiment described) is recorded by digital voice recorder, and stored in the relevant content record for the celebrity in the authenticated content database 40 in association with corresponding authenticated photographic content. The association with authenticated photographic content provides authentication for the audio content.
Where video content is concerned, the method comprises capturing a video of the source (i.e. the celebrity) by digital video camera. To provide the authentication, the celebrity autographs a clear glass placed in front of the digital video camera during or at a close of the video. This ensures, as with the case of photographic content, that an autograph · is captured of the celebrity. The autographed video is then saved in the relevant content record for the celebrity in the authenticated content database 40. Optionally, a trade mark under which the product generation system 10 is provided, such as the twiy™ logo, is digitally pasted onto the recorded video.
Any captured content may be stored in alphanumeric sequence in the authenticated content database 40 for future use.
It will, be appreciated that the invention is hot limited to the described method and digital media apparatus for capturing and authenticating content, and in alternative embodiments of the invention other methods, techniques and apparatus may be used.
It should be further appreciated by the person skilled in the art that the invention is not limited to the embodiments described. For example, the invention as described can include the following modifications and/or additions:
• Advertising may be linked to or included in the generated product. For example, trade marks or scrolling images or text could be incorporated into a configured video message product, or stamped onto a configured photograph message product;
• The invention may be embodied as an application on a smartphone, such as an IPHONE® application;
• Rather than paying per product generated, alternative payment methods may be used. For example, consumers may pay a one off joining or registration fee entitling them to access to all of the content of the authenticated content database for use in products, with any communication of generated products being charged at the cost of a network providers fee;
• The content specification information communicated may comprise a request for advice from the source, such as cooking advice or fashion advice, in which case the system is operable to process the content specification information and generate a product comprising a reply of advice including content from the authenticated content database. In the case of a request for cooking advice from a well known celebrity chef, the submitted content specification information may include a list of specified ingredients in the client's kitchen. Authenticated content sourced from the celebrity chef and contained in the authenticated content database may include recipes approved by the celebrity chef, and the reply of advice may include celebrity chef approved recipes using the ingredients specified by the consumer. As another example, in the case of a request for fashion advice from a well known model and representative of a retail store, the submitted content specification information may include an event that the client is attending. Authenticated content sourced from the model and contained in the authenticated content database may include items, of clothing on sale in the store and approved by the model, and the reply of advice may include approved items of clothing for the event specified by the consumer. ill be appreciated by those skilled in the art that variations and modifications the invention described herein will be apparent without departing from the spirit and scope thereof. The variations and modifications as would be apparent to persons skilled in the art are deemed to fall within the broad scope and ambit of the invention as herein set forth.
Also, future patent applications may be filed in Australia or overseas on the basis of, or claiming priority from, the present application. It is to be understood that the following provisional claims are provided by way of example only, and are not intended to limit the scope of what may be claimed in any such future application. Features may be added to or omitted from the provisional claims at a later date so as to further define or re-define the invention or inventions.

Claims

THE CLAIMS DEFINING THE INVENTION ARE AS FOLLOWS:
1. A system for generating a product, the system comprising processor means and a storage means, the storage means having a software application and a database of content stored thereon, whereby the processor is operable, under control of the software application, to: receive a request for the product, the request comprising a specification of content from the database to be included in the product; and generate the product on the basis of the request.
2 The system according to claim 1 , wherein the content is derived from a source, and an authentication is associated with the content to indicate valid derivation from the source.
3. The system according to claim 2, wherein the source is a celebrity, and the content comprises at least one of: a photograph of the celebrity; an audio from the celebrity; a text from the celebrity; and/or a video of the celebrity.
4. The system according to claim 2 or 3, wherein the authentication comprises an autograph or signature of the celebrity.
5. The system according to any one of claims 1 to 4, wherein the system is operable to communicate with a device.
6. The system according to claim 5, wherein the system is operable to communicate the product to the device for execution via a user interface of the device.
7. The system according to claims 5 or 6, wherein the device comprises an Internet enabled device, and the communication is via the Internet.
8. The system according to claim 6 or 7, wherein the device is a personal computer.
9. The system according to claim 6 or 7, wherein the device is a smartphone.
10. The system according to any one of claims 6 to 9, wherein the user interface comprises a graphical user interface or human machine interface comprising a display or touch screen.
1 1. The system according to any one of claims 6 to 9, wherein the system is operable to receive a data communication from the device.
12. The system according to claim 11 , wherein the data communication comprises a request for the product;
13. A method of generating a product, the method comprising: receiving a request for the product, the request comprising a specification of content to be included in the product; and generating the product on the basis of the request.
14. The method according to claim 13, wherein the content is derived from a source, and the method further comprises associating an authentication with the content to indicate valid derivation from the source.
15. The method according to claim 14, wherein the source is a celebrity, and the content comprises at least one' of: a photograph of the celebrity; an audio from the celebrity; a text from the celebrity; and/or a video of the celebrity.
16. The method according to claim 15, wherein the authentication comprises an autograph or signature of the celebrity.
17. A computer-readable storage medium on which is stored instructions that, when executed by a computing means, causes the computing means to perform the method according to any one of claims 13 to 16.
18. A computing means programmed to carry out the method according to any one of claims 13 to 16.
19. A system for generating a product substantially as hereinbefore described with reference to the accompanying drawings.
20. A method of generating a product substantially as hereinbefore described with reference to the accompanying drawings.
21. A computer-readable storage medium on which is stored executable instructions substantially as hereinbefore described with reference to the accompanying drawings.
22. A computing means substantially as hereinbefore described with reference to the accompanying drawings. ·
